Terms and Conditions
1. Although all information supplied by Fresh Eyes: Prep For Sale to the Client is given in good faith, the Client should satisfy themselves that all details and information provided to them is current and appropriate to their needs.
2. Advice given by Fresh Eyes: Prep For Sale is generally of a cosmetic nature and does not cover structural issues as Fresh Eyes: Prep For Sale does not give structural advice. Before undertaking structural alterations or major repairs to the Property the Client is strongly advised to seek relevant professional advice from a suitably qualified architect or builder.
3. While Fresh Eyes: Prep For Sale will use all reasonable endeavours to enhance the value and marketability of the Property, we do not guarantee:
- That the Property will sell.
- That the Property will sell any faster than if Fresh Eyes: Prep For Sale had not provided its services.
- That the Property will return a higher price than if Fresh Eyes: Prep For Sale had not provided its services.
4. It is a condition of this agreement that all amounts payable by the Client to Fresh Eyes: Prep For Sale pursuant to this agreement are paid within the stipulated time frames. In the event that any amount is not paid within the stipulated time frame, all amounts payable by the Client to Fresh Eyes: Prep For Sale pursuant to this agreement become immediately due and payable (whether legally demanded or not). All amounts contemplated by this agreement are inclusive of GST.
5. All amounts payable by the Client to Fresh Eyes: Prep For Sale pursuant to this agreement will be accepted by cheque, cash or electronic funds transfer. Please telephone us at 604.626.9802 or email us at info@lynettesfresheyes.com for more information.
6. Fresh Eyes: Prep For Sale may recommend or use other businesses in providing the Client with the goods and/or services contemplated by this agreement. Any business used by Fresh Eyes: Prep For Sale or recommended to the Client by Fresh Eyes: Prep For Sale is done so for the convenience of the Client only. Fresh Eyes: Prep For Sale accepts no responsibility for the goods or services provided by any other business which has been recommended or used by Fresh Eyes: Prep For Sale. The Client should satisfy themselves of the suitability of any other business before entering into any contract for goods or services with that business. Fresh Eyes: Prep For Sale will not engage any other Business to provide goods or services in respect of the Property without the express written consent of the Client. The Client is encouraged to provide feedback via info@lynettesfresheyes.com or by telephone at 604.626.9802 regarding businesses used and Fresh Eyes: Prep For Sale will monitor good practice.
7. In the event that Fresh Eyes: Prep For Sale uses or recommends to the Client another business as contemplated by clause 6 of these Terms and Conditions, the Client is directly responsible for all charges, liabilities or accounts issued by that business in respect of the Property.
8. A consultation in the Property will take approximately 1-2 hours and the majority of the house will be viewed and discussed during this time. However, areas without a standard access or without a full staircase are not included and the consultant maintains the right to exclude any areas at any time which are not regarded as safe or appropriate.
9. Fresh Eyes: Prep For Sale will obtain rental items for the Client through a third party staging rental company, at rates to be agreed between the parties. All rental items for the purposes of Home Staging or Event Decoration remain the property of the third party rental company and damaged items will be invoiced to the Client at the purchase price plus any rental owing on the item plus an additional monthly rental fee. Payment of all amounts contemplated by this clause is due within 14 days of the date on the invoice from Fresh Eyes: Prep For Sale.
10. Any suggestions made in the action plan after a consultation are as a result of the initial viewing of the property and/or photographs and information supplied by the client. The advice provided by Fresh Eyes: Prep For Sale is given in good faith and the client should satisfy themselves, before taking action as a result of this report, that they are satisfied with the cost effective measures and have taken all necessary health and safety precautions as necessary in undertaking any improvements or alterations to their property. Fresh Eyes: Prep For Sale cannot accept responsibility for any loss, injury or inconvenience sustained by any person using any information howsoever provided by Fresh Eyes: Prep For Sale.
11. All emails received and sent are virus checked and security of information is safeguarded as much as possible. However, it is understood that the Internet cannot be regarded as a completely secure medium.
12. Fresh Eyes: Prep For Sale will never knowingly pass your information on to another party without your authorization.
13. All of the pictures taken by Fresh Eyes: Prep For Sale are the copyright of Fresh Eyes: Prep For Sale and anyone wishing to copy the detail for commercial purposes must seek authorization from Fresh Eyes: Prep For Sale. Fresh Eyes: Prep For Sale reserves the right to use all photographs taken on behalf of clients for promotional purposes, both printed and online.
14. In this agreement words importing the singular or plural number include the plural and singular number respectively and words of any gender shall include any other gender where two or more persons are included in the expression "the Client" then the liability under any covenant agreement or obligation herein set forth (whether express or implied) shall be joint and several.
